Terms and Conditions

These Terms govern use of the Breve platform, including registration, job posting, matching, escrow-style payment handling, payouts, disputes, and account conduct.

These Terms are intended to work alongside applicable Kenyan law, including the Advocates Act, the Advocates Remuneration Order, the Data Protection Act, 2019, and the legal framework governing electronic records and digital transactions.
These Terms are subject to change. Breve may post updated Terms in the app or on the website and may communicate material changes to the registered email address on the account.

Acceptance of the Terms

By creating an account, accessing the website or app, posting a job, declaring interest in a job, uploading material, making a payment, or otherwise using Breve, the user agrees to be bound by these Terms and by any additional policy or workflow rules incorporated into the service.

If a user does not agree to these Terms, the user must not use the platform.

Nature of the Platform

Breve is a technology platform that facilitates the posting, matching, administration, payment handling, and operational tracking of legal-workflow tasks, including holding brief and related court instructions.

Unless expressly stated otherwise in a written agreement, Breve is not a law firm, does not become a party to the advocate-client relationship between users, and does not provide legal advice on the merits of any case or instruction.

Accounts and Eligibility

Users must provide accurate, current, and complete information at registration and throughout use of the platform, including identity, contact, professional, and payout details where required.

Where a workflow is limited to advocates or regulated professionals, the user represents that they hold the required qualification, standing, and authority under applicable law, including the Advocates Act where relevant.

Users are responsible for all activity conducted through their account, for maintaining credential security, and for promptly notifying Breve if their eligibility, authority, or account security changes.

Jobs, Matching, and Workflow

Breve allows users to post task details, specify deadlines and locations, upload files, request physical or virtual appearances, invite or receive declarations of interest, assign work, communicate updates, and manage the operational status of a job through completion, cancellation, dispute, refund, or payout.

Breve may use filters, verification rules, profile data, and workflow logic to prioritise, route, or limit access to certain work opportunities in order to support service quality, fraud prevention, and platform safety.

Professional Obligations and Confidentiality

Users remain personally responsible for complying with all professional, ethical, statutory, and court-imposed duties that apply to the work they accept or post, including confidentiality obligations, conflict duties, and scope-of-practice restrictions.

Where legal or case-sensitive material is shared through Breve, users must disclose only what is reasonably necessary for the work requested and must handle all information in a manner consistent with professional obligations, including advocate-client privilege where applicable.

Fees, Payments, and Escrow

Breve may charge platform fees, processing fees, payout-related charges, dispute-related deductions, or other disclosed charges. Users are responsible for all charges properly associated with their use of the platform.

Unless the workflow states otherwise, job payments are collected upfront and held in a controlled system flow pending completion, cancellation, dispute outcome, refund processing, or payout release. Payment release may be subject to review windows, fraud checks, charge verification, dispute holds, or administrative intervention.

Refunds, partial releases, splits, credits, or carry-forward balances may be processed according to the rules of the relevant job, dispute outcome, payment channel, and applicable fees. Provider transaction charges, platform charges, and non-recoverable transfer costs may be deducted where the law and disclosed workflow permit it.

Where relevant, parties remain responsible for ensuring that legal fees and billing practices comply with applicable law and with the Advocates Remuneration Order.

Operational Communications and Consent to Notices

Users consent to receive transactional and operational communications from Breve by in-app notice, email, SMS, push notification, or another channel used for the service. These communications may include login verification, payment status, assignment updates, dispute events, cancellation notices, payout notices, and policy updates.

A notice sent to the most recent email address or phone number provided by the user may be treated as valid notice for account and service purposes, subject to any mandatory legal requirements.

Prohibited Conduct

Users must not misrepresent identity, qualifications, authority, payments, attendance, completion status, or supporting records. Users must not post unlawful work, submit false disputes, manipulate reviews, misuse another person's data, attempt to bypass the platform's payment flow, or interfere with the service's integrity or security.

Breve may investigate suspected misuse, require supporting records, freeze funds where reasonably necessary, and restrict access while a matter is under review.

Electronic Records, Logs, and Audit Trail

Breve may maintain electronic records of account activity, audit events, messages, uploads, payments, refunds, payouts, and other platform events for operational, evidential, compliance, and security purposes.

Users agree that electronic logs, confirmations, notices, timestamps, and related records generated or stored by the platform may be relied on for service administration, subject to applicable law governing electronic records and evidential use.

Disputes, Cancellations, and Platform Action

Where a job is challenged, cancelled, not performed, or otherwise disputed, Breve may place the affected funds or workflow in review and may request documents, explanations, or confirmations from the affected users.

Breve may issue a refund, a full release, a split, a platform credit, or another resolution available in the system rules after considering the available records, the payment state, provider constraints, and the conduct of the parties. Breve may also escalate the matter to support, compliance review, mediation, external advice, or legal process where appropriate.

Suspension, Restriction, and Termination

Breve may suspend, restrict, freeze, or terminate an account, listing, payment, payout, or workflow where it reasonably believes there has been a breach of these Terms, fraud risk, unlawful conduct, security risk, regulatory concern, or other conduct harmful to users or to the platform.

Breve may preserve relevant records and may continue to process outstanding disputes, payment reversals, refunds, payouts, or compliance obligations after an account is restricted or closed.

Disclaimers and Liability

Breve provides the platform on an as-available and as-updated basis. To the extent permitted by law, Breve does not warrant uninterrupted availability, error-free operation, a guaranteed match, or a guaranteed legal outcome for any user or matter.

Each user remains responsible for the legality, accuracy, sufficiency, and consequences of the instructions, documents, representations, and professional work they provide through the platform.

Changes to the Terms

These Terms are subject to change from time to time to reflect legal, operational, product, payment, security, or business updates.

Where a change is material, Breve may publish the revised Terms in the app or on the website and may send notice to the registered email address on the account before or when the revised Terms take effect. Continued use after the effective date of the revised Terms may constitute acceptance of the updated Terms.

Governing Law and Contact

These Terms are governed by the laws of Kenya unless a mandatory rule requires otherwise.
